By requesting a quote, entering into a service agreement, or otherwise using the services of Texas Construction INC (TXC), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These Terms apply to all visitors, users, and others who access or use the Service.
2. Services Provided
TXC provides professional construction and roofing services, including, but not limited to: residential roofing, commercial roofing, new roof installation, roof repair, roof replacement, storm damage repair, and hurricane restoration. All services will be performed in accordance with the specifications detailed in your specific service contract or proposal.
3. Client Obligations
- Access: The Client agrees to provide timely access to the property and necessary utilities (e.g., electricity, water) required for TXC to perform the contracted services.
- Information: The Client is responsible for providing accurate and complete information regarding the scope of work and existing property conditions.
- Safety: The Client agrees to keep pets and minors away from the work area while services are being performed.
4. Payment Terms and Invoicing
- Pricing: All pricing will be detailed in the written proposal or contract provided by TXC.
- Deposit: A non-refundable deposit may be required before work commences, as specified in the contract.
- Invoicing: Invoices will be issued upon completion of project milestones or the entire project, as outlined in the contract.
- Late Payments: Payments are due upon receipt unless otherwise stated. TXC reserves the right to charge a late fee for overdue balances.
- Lien Waivers: Upon final payment, TXC will provide necessary lien waivers to the Client.
5. Guarantees and Warranties
TXC warrants that all services will be performed in a professional and workmanlike manner. Specific material and labor warranties will be outlined separately in the contract. This warranty is void if the damage is caused by client misuse, lack of maintenance, or acts of nature (e.g., subsequent storms).
6. Limitation of Liability
Texas Construction INC (TXC) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or revenue, whether incurred directly or indirectly. The total liability of TXC to the Client for any and all claims arising out of or related to the services shall not exceed the total amount paid by the Client to TXC for those services.
7. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising out of or relating to these Terms or the services provided shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to binding arbitration in a mutually agreeable Texas county, or as otherwise required by law.
8. Changes to Terms
TXC reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
